In many estate planning exercises, superannuation held via a self managed superannuation fund (SMSF) is either the second largest – or largest – asset.

As life expectancies grow, so to does the probability that control of SMSF assets will need to be managed prior to a member’s death.

At a minimum it is therefore  critical for all advisers to understand the interplay between the state based enduring power of attorney regime and the federal  rules regulating SMSFs.

This session will explore all the key issues in this regard, including:

  1. The implications of leading recent court cases
  2. The interrelationship between attorneys, SMSFs and binding death benefit nominations
  3. The ability for attorneys to make withdrawals prior to death – and mandate post death distributions via BDBNs
